Terms & Conditions
1. Scope
The following General Terms and Conditions in their most current version at the time of order shall exclusively govern the business relationship between periscope sàrl, Luxembourg, here acting under the brand JEAN BETTINGEN – PHOTOGRAPHER & VISUAL ARTIST (in the following ‘JEAN BETTINGEN’), and the orderer. JEAN BETTINGEN shall not recognise any differing terms set out by the orderer unless such conditions have been expressly agreed to in writing.
2. Conclusion of contract
The display of works in the online shop does not constitute a legally binding offer; it is a non-binding online catalogue only. The works you have selected by pressing the “Purchase” button are summarised again for you in an order overview at the end of the order process. Here you can review the various information provided during the order process and add to or correct it by clicking the “Edit” buttons. By clicking the button “Purchase”, you send your order details and make a binding declaration to JEAN BETTINGEN that you want to purchase the products listed there (Offer). JEAN BETTINGEN automatically accepts your offer upon receipt of your order. Directly after sending the order, you will receive an email with an order confirmation, in which the details of your order are listed again.
3. Cancellation & Returns
3.1. Order Cancellation
You have the right to cancel this contract without reason within 14 calendar days as of the date of the order placement.
To exercise your right to cancel, you must inform JEAN BETTINGEN immediately of your decision to cancel in a clear, written statement by email.
The deadline for the right to cancel will be met as long as your statement indicating you will be exercising the right to cancel is sent within the allotted cancellation period.
Upon the cancellation of your order, your paid amount will be refunded within 7 days in full to your original method of payment. Depending on your credit card issuer’s policies, you will receive the credit in a given amount of days after JEAN BETTINGEN has refunded the due amount.
Once the artwork has been shipped, the order cannot be cancelled anymore but must be handled as a return (see point 3.2 below).
3.2. Returns
You have the right to return the artwork purchased through art.jeanbettingen.com within 14 days of its reception. If you wish to return the artwork, please contact JEAN BETTINGEN within the legal timeframe to clarify the return details.
Please ship the artwork back in the original packaging without delay. At the very latest, it must be sent back within 14 calendar days of the day that you informed JEAN BETTINGEN of the intended return.
The artwork must be returned in mint condition; artworks that have been damaged while in your custody are not eligible for a refund.
Please note that the certificate of authenticity, that has been delivered together with the artwork, must be returned as well. A return without the certificate of authenticity is not eligible for a refund.
The refund will be withheld until the artwork has been received by JEAN BETTINGEN and its condition has been verified. After that, the paid amount for the artwork will be credited back to your original method of payment, unless otherwise agreed upon. Please note that the initial shipping costs that you paid while placing your order are not eligible for a refund.
The direct costs of the return shipment to JEAN BETTINGEN are at your expense.
4. Shipping and Delivery
Please note that orders are typically shipped within 10-14 business days. JEAN BETTINGEN ships the artwork as quickly as possible, but any additional reasonable delays do not grant you the right to refuse the delivery or to demand a price reduction.
Unless agreed otherwise, the delivery will be made to the delivery address specified by you during the order process. JEAN BETTINGEN cannot be held responsible for delayed or misguided shipments due to errors in the delivery address given during the order process. In case that shipments are returned to Jean Bettingen, the shipping costs will be charged again.
Shipments will be made through Post Luxembourg or through various carriers such as UPS or DHL. All shipments are trackable, and the tracking number will be communicated to you via email as soon as the artwork has shipped. Please note that JEAN BETTINGEN cannot be held responsible for errors, theft or delays by the parcel services.
5. Prices, due date, and payment
The prices stated on art.jeanbettingen.com are final prices including VAT. Shipping costs are not included in the price and are added to it in each case during the check-out process.
The purchase price is paid in full via credit card at the moment of the order placement. The secured payment process is handled through the online payment provider STRIPE.
6. Shipping costs
When placing your order on art.jeanbettingen.com, please select the country of the desired shipping destination; the correct shipping costs will then be clearly indicated and added to the global amount due.
7. Import taxes
Please be aware that import taxes may apply for shipments outside of the European Union. You are responsible for filing the appropriate declarations and paying any possible import taxes.
8. Retention of title
Until full and final payment of any possible outstanding amounts, the delivered artworks shall remain the property of JEAN BETTINGEN.
9. Variations of colors and materials
Due to the nature of representations of colors, contrasts, and materials on computers screens, the final artworks may vary slightly in color, contrasts, luminosity, and material texture from the artwork representation on art.jeanbettingen.com These variations are inherent to the representation technology and don’t constitute grounds for complaints, refunds or demands of artwork replacements.
Furthermore, artworks may show changes or fading of colour and/or contrasts over time, especially if exposed to direct sunlight or hanged above radiators. These variation occurrences over time don’t constitute grounds for complaints, refunds or demands of artwork replacements.
10. No transfer of rights
By buying a photographic artwork, you are only acquiring material ownership of the artwork. No other rights are granted or implied. Any reproduction (copying), dissemination, leasing, public exhibition or other analogue or digital use is not permitted unless authorized by law. However, you may resell the print.

12. Applicable law
All transactions made via jean.bettingen.com are subject to Luxembourgish law.
